These Terms and Conditions (“Terms”) govern your use of the website and the purchase or use of heating, ventilation, and air conditioning (“HVAC”) services provided by Pardee's Refrigeration and Air Conditioning (“Pardee's,” “we,” “us,” or “our”).

By accessing our website, requesting an estimate, scheduling service, purchasing equipment, or engaging our services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or services.

1. Services

Pardee's provides HVAC-related services, which may include:

  • Heating and air conditioning installation, repair, replacement, and maintenance
  • Refrigeration services
  • Preventive maintenance and service agreements
  • HVAC equipment inspections and diagnostics
  • Indoor air quality services
  • Ductwork and related services
  • Emergency or after-hours service, where available
  • Sale and installation of HVAC equipment and related products
  • Other services described in an estimate, proposal, work order, invoice, or service agreement

The specific services to be provided will be described in the applicable estimate, proposal, work order, or other service documentation.

2. Estimates and Proposals

Estimates and proposals are based on the information available to Pardee's at the time they are prepared.

Unless otherwise stated in writing:

  • Estimates are not guarantees of the final cost.
  • Additional work or unforeseen conditions may result in additional charges.
  • Hidden, inaccessible, deteriorated, damaged, or code-related conditions may require additional labor or materials.
  • Changes requested by the customer after approval may result in additional charges.
  • Equipment, parts, materials, permits, disposal, access requirements, and other project conditions may affect the final price.

Where practical, Pardee's will communicate material changes in scope or price before performing additional chargeable work.

3. Customer Responsibilities

Customers are responsible for:

  • Providing accurate contact and property information.
  • Providing Pardee's technicians reasonable and safe access to equipment and areas requiring service.
  • Informing Pardee's of known hazards, property conditions, or special access requirements.
  • Removing or securing personal belongings as reasonably necessary to permit access.
  • Obtaining any customer-required permissions from landlords, property owners, homeowners' associations, tenants, or other parties.
  • Maintaining utilities necessary for testing or operating equipment, unless otherwise agreed.
  • Providing accurate information regarding existing equipment and previous repairs when known.

Pardee's may postpone or decline work when conditions present an unreasonable safety risk or when required access, information, approvals, or utilities are unavailable.

4. Scheduling and Appointments

Service appointments are scheduled based on technician availability and the nature of the requested service.

Appointment times are estimates and may be affected by emergency calls, weather, traffic, equipment availability, job complexity, or circumstances outside Pardee's control.

Pardee's will make reasonable efforts to communicate significant scheduling changes.

5. Cancellations and Rescheduling

Customers should provide reasonable notice when cancelling or rescheduling an appointment.

Cancellation, diagnostic, dispatch, restocking, equipment, permit, or other applicable charges may apply when disclosed to the customer before or during the transaction.

For installation projects or special-order equipment, cancellation and refund terms may also be governed by the applicable proposal, contract, purchase agreement, or manufacturer requirements.

6. Authorization to Perform Work

By approving an estimate, work order, proposal, service agreement, or other authorization, the customer authorizes Pardee's to perform the work described in that document.

Additional work generally requires customer approval unless immediate action is reasonably necessary to protect property, address a safety issue, or prevent further damage and the circumstances reasonably permit such action.

Electronic approvals, signatures, text-message approvals, email approvals, and other legally recognized forms of authorization may be accepted where permitted by applicable law.

7. Payment

Payment is due according to the terms stated on the applicable invoice, proposal, work order, service agreement, or other written agreement.

Unless otherwise agreed in writing:

  • Payment is due upon completion of service.
  • Installation projects may require deposits, progress payments, or other payment arrangements stated in the applicable agreement.
  • Customers are responsible for applicable taxes, fees, permit charges, and other disclosed costs.
  • Returned payments, rejected payments, or other payment-processing issues may result in applicable charges to the extent permitted by law.

Pardee's reserves all rights and remedies available under applicable law for unpaid amounts.

8. Financing

If financing is offered through a third-party financing provider, financing is subject to the terms, eligibility requirements, approvals, and agreements of that provider.

Pardee's does not guarantee financing approval or financing terms unless expressly stated in writing.

9. Equipment and Parts

HVAC equipment and parts may be subject to availability, manufacturer specifications, substitutions, shipping delays, and discontinued products.

Where a particular model or component is unavailable, Pardee's may propose a comparable alternative subject to customer approval.

Manufacturer warranties, when applicable, are provided by the manufacturer and are subject to the manufacturer's terms and conditions. Pardee's does not expand or modify a manufacturer's warranty unless expressly agreed in writing.

10. Workmanship Warranty

Any workmanship warranty provided by Pardee's will be governed by the terms stated in the applicable proposal, invoice, service agreement, or warranty document.

Unless otherwise expressly stated in writing, a workmanship warranty does not cover:

  • Damage caused by misuse, neglect, abuse, or unauthorized modification.
  • Damage caused by circumstances outside Pardee's control.
  • Normal wear and tear.
  • Damage caused by electrical, structural, plumbing, environmental, or other conditions unrelated to Pardee's work.
  • Repairs or modifications performed by persons other than Pardee's or its authorized representatives.
  • Failure of customer-supplied equipment or materials.
  • Failure caused by improper operation or failure to perform required maintenance.

Nothing in these Terms is intended to eliminate or limit any warranty or consumer right that cannot legally be excluded or limited.

11. Existing Conditions and Pre-Existing Problems

HVAC systems consist of interconnected equipment, components, electrical systems, ductwork, controls, refrigerant circuits, drainage systems, and other components.

Repairing one component may reveal or contribute to the discovery of another existing problem. Unless specifically included in the scope of work, Pardee's is not responsible for pre-existing defects, concealed conditions, deterioration, code violations, or failures unrelated to the work performed.

12. Refrigerant and Environmental Requirements

HVAC and refrigeration systems may contain refrigerants or other regulated substances.

Pardee's will handle refrigerants and related materials in accordance with applicable laws, regulations, manufacturer requirements, and industry practices.

Additional charges may apply when recovery, disposal, reclamation, environmental compliance, or other specialized procedures are required and were not included in the original scope.

13. Permits and Code Requirements

Where required, permits and inspections may be obtained or coordinated as described in the applicable proposal or agreement.

Code requirements, permitting requirements, inspection requirements, and governmental requirements may affect the scope, cost, or timing of a project.

Unless expressly included in writing, Pardee's is not responsible for upgrades or modifications required by a governmental authority that are outside the original scope of work.

14. Property Access and Protection

Pardee's will use reasonable care when working at a customer's property.

Customers acknowledge that HVAC work may require access to attics, crawl spaces, mechanical rooms, roofs, exterior areas, ceilings, walls, electrical components, ductwork, or other areas.

Pardee's is not responsible for damage resulting from pre-existing conditions, concealed conditions, defective construction, deterioration, or conditions that could not reasonably have been identified before work began.

Customers should notify Pardee's of fragile surfaces, valuables, hazards, or other conditions requiring special precautions.

15. Emergency and After-Hours Services

Emergency, weekend, holiday, or after-hours service may be subject to different rates, availability, response times, or service conditions.

A request for emergency service does not guarantee immediate service or a particular response time.

16. Website Use

The content of this website is provided for general informational purposes.

While Pardee's makes reasonable efforts to maintain accurate information, we do not guarantee that website content is complete, current, error-free, or available at all times.

You agree not to:

  • Use the website for unlawful purposes.
  • Attempt to interfere with the operation or security of the website.

These Terms, together with any applicable proposal, estimate, work order, invoice, service agreement, warranty, and other written agreement between Pardee's and the customer, constitute the agreement governing the applicable services, except where a separate written agreement expressly supersedes or modifies these Terms.
